The Court Services Section is comprised of four units. , , and . The Court Services Unit is supervised by Capt. Brian McCandless. The Court Security Unit is supervised by Sgt. Paul Daniel. The Civil Service Unit is supervised by Sgt. Brian Roberson, and the Civil Process Unit is supervised by Manager Janet McAllister and Assistant Manger Wendy McAllister.

THE COURT SECURITY UNIT


The Court Security Unit has 25 security officers/civilians that provide Law Enforcement services for all thirteen courtrooms, the Constitutional Office Complex, all County Commission meetings, as well as Code Enforcement meetings, and Local Planning Agency meetings. The Court Security Units goal is to provided a secure and organized environment for all persons entering or attending a desired function within the control of the Court Security Unit.

Civilian Security Officers are a great asset to the Court Security Unit. They provide support at the entrances of the Court House Complex as well as security for the Complex.

Court holding is located at the Martin County Court House Complex. Court Holding consists of three Deputies D/S Jacqueline Gore, D/S Mart Hester and D/S Mathew Pope , all are responsible for the security and safety of all inmates being brought to the Courthouse for their court appearances and for those being sentenced within the court system. Court holding is also responsible for the collecting of Court ordered DNA.

CIVIL PROCESS

The Martin County Sheriffs Office Civil Service Unit is supervised by Sgt. Brian Roberson and has five Deputies serving Civil papers throughout Martin County. The Civil Process Unit is supervised by Manager Janet McAllister and Asst. Manager Wendy McAllister.
The Sheriff is required by Florida Statute to serve enforceable and non-enforceable legal process from any and all courts in the State of Florida. All Enforceable process issued from any court in this State must be served by the Sheriff. These types of process include enforcement of child support, domestic violence injunctions, landlord/tenant actions, and seizure of property relating to civil lawsuits. In 2008 these Units processed, served, and generated more than 37,525 Affidavits of Service documents.

MARTIN COUNTY SHERIFF’S OFFICE FEE SCHEDULE

The Martin County Sheriff’s Office establishes the following fees in accordance with Florida State Statute 30.231 as follows:

***No personal or business checks excepted - Cashiers check or money orders only

FLORIDA SERVICE

$40.00

This fee applies to ALL documents being served that have a case originating in the State of Florida, including all Alias and Pluries Services.

OUT OF STATE SERVICE

$70.00

This fee applies to documents being served from any other State. Please include any special instructions required or documents for legal filing of affidavit of service in your state.

WRIT OF POSSESSION

$90.00

The fee includes thirty (30) minutes for one Deputy Sheriff at the site. Should additional staff be required there will be a charge of $35 per hour, or for any part of an hour.

WRIT OF REPLEVIN

$90.00

Pick up of vehicles require a cost deposit of $350. Vehicles are towed when they are located. You will be notified and may make arrangements to retrieve the vehicle from the storage facility. The towing fee and any storage fees are then paid to the facility. Sheriff’s fees are paid from this amount. Any refund of cost deposit will be made promptly after all expenses have been paid. All other personal property will be immediately turned over to the Defendant at the time of the Replevin. You will be responsible for making any arrangements for transport unless otherwise directed by court order.

Cost Deposit Required

As per Florida Statute, fees are charged for pickup, per diem, transportation, and any other related expenses. The cost deposit required for this county is $450 ($40 service fee, $50 for seizure of property or persons, $260 minimum 3 day incarceration fee, $100 transportation). Incarceration fees and transportation fees are refunded if the defendant is not arrested within one year of the received date of the Writ. We will attempt to collect from the Defendant these expenses provided the order allows us to do so and the defendant purges the contempt. After expenses have been paid, you will receive the documents required by law and your refund promptly.

WRIT OF EXECUTION

Cost Deposit Required

Cost deposits for levies are decided at the time this office receives Instructions for Levy. The minimum cost deposit for personal property is $2000, the minimum cost deposit for real property is $1500; all fees are paid from this amount. The minimum cost deposit for the levy of property located in a small business is $3500.

SPECIAL CONSIDERATIONS

Should any order require more time than allowed in the basic fee, all time shall be calculated at $35 per hour, or for any part of an hour. Should additional personnel be required, each deputy or employee shall be calculated at $35 per hour, or for any part of an hour.

The Sheriff’s Office will make the determination as to the necessary staff required to efficiently execute the order or levy; and decide the amount of cost deposit required to cover anticipated expense. All effort is made to minimize costs and time for the Sheriff as well as the person requesting these services.

If you are a victim of Domestic Violence, Repeat Violence, or Dating Violence, contact this office immediately for assistance or call 911 for emergency assistance.
Protection orders from other states are enforceable under the Full Faith and Credit Statute. Please call for information regarding registration of your documents.
